Acceptable Use Policy
Permitted and prohibited uses of the Foveate platform

1. Purpose
This Acceptable Use Policy (“AUP”) defines the permitted and prohibited uses of the Foveate platform. It protects our users, our infrastructure, and the integrity of the service. By using Foveate, you agree to comply with this policy.
Violations of this policy may result in suspension or termination of access as described in our Termination of Contract policy.
2. Scope
This policy applies to:
- All users of the Foveate platform, including account holders, team members, and viewers.
- All content uploaded, created, or shared through the platform.
- All interactions with the Foveate API and integrations.
- All communications sent through Foveate (sharing links, viewer notifications, comments).
3. Permitted Uses
Foveate is designed for professionals to create, share, and track interactive presentations. Permitted uses include:
- Creating and sharing presentations for business, educational, or creative purposes.
- Uploading 3D models, images, videos, and documents you have the right to use.
- Embedding Foveate presentations on your own websites or applications.
- Using analytics to understand how viewers engage with your content.
- Integrating Foveate with other tools via our API in accordance with API documentation.
- Inviting team members and collaborators to your organization's workspace.
4. Prohibited Uses
The following uses of Foveate are strictly prohibited:
4.1 Illegal Content and Activities
- Content that violates any applicable law, regulation, or legal obligation.
- Content that infringes intellectual property rights (copyright, trademark, trade secrets) of others.
- Content related to illegal goods, services, or activities.
- Using Foveate to facilitate fraud, phishing, or other deceptive practices.
4.2 Harmful Content
- Content that promotes violence, terrorism, or harm to individuals or groups.
- Hate speech, harassment, or content that discriminates based on protected characteristics.
- Sexually explicit content or content exploiting minors.
- Content that invades privacy or shares personal information without consent.
- Malware, viruses, or other malicious code.
4.3 Platform Abuse
- Attempting to gain unauthorized access to Foveate systems, other users' accounts, or data.
- Circumventing security measures, access controls, or usage limits.
- Interfering with the operation of the platform or degrading service for other users.
- Automated access (scraping, bots) without explicit written permission.
- Reverse engineering, decompiling, or attempting to extract source code.
- Reselling or redistributing Foveate access without authorization.
4.4 Misrepresentation
- Impersonating another person, organization, or Foveate itself.
- Creating fake accounts or misrepresenting your identity or affiliation.
- Using Foveate to send spam, unsolicited communications, or misleading messages.
4.5 Data Misuse
- Collecting viewer data beyond what is disclosed in your own privacy policy.
- Using viewer analytics for purposes unrelated to legitimate business interests.
- Sharing access credentials or API keys with unauthorized parties.
- Storing prohibited categories of data (e.g., payment card numbers, health records) in presentation content fields not designed for such data.
5. Content Ownership and Rights
You retain ownership of content you upload to Foveate. By uploading content, you represent and warrant that:
- You own the content or have obtained all necessary rights, licenses, and permissions.
- Your use of the content does not infringe any third-party intellectual property rights.
- You have obtained any required consents from individuals depicted in your content.
Foveate does not claim ownership of your content. We access and process your content only to provide the service as described in our Privacy Policy.
6. Security Responsibilities
Users are responsible for maintaining the security of their accounts:
- Use strong, unique passwords and enable multi-factor authentication when available.
- Do not share login credentials or API keys.
- Notify Foveate immediately at legal@foveate.com if you suspect unauthorized access to your account.
- Ensure that team members you invite comply with this policy.
7. API and Integration Usage
If you access Foveate through our API:
- Comply with all rate limits and technical restrictions documented in our API documentation.
- Do not use the API in ways that could damage, disable, or impair the platform.
- Secure your API keys and rotate them if you suspect compromise.
- Include appropriate attribution when displaying Foveate content in third-party applications.
8. Reporting Violations
If you become aware of any violation of this policy, please report it to legal@foveate.com. Reports should include:
- Description of the violation.
- URL or identifier of the content or account involved.
- Any supporting evidence or context.
We investigate all reports and take appropriate action. Reporters may remain anonymous.
9. Enforcement
Foveate reserves the right to investigate suspected violations and take action including:
- Warning: Notification of the violation with a request to remedy.
- Content removal: Removing or disabling access to violating content.
- Suspension: Temporary suspension of account access pending investigation.
- Termination: Permanent termination of access per our Termination of Contract policy.
- Legal action: Pursuing legal remedies for violations that cause harm to Foveate or third parties.
The severity of enforcement depends on the nature of the violation, whether it is a first or repeated offense, and the harm caused.
10. Changes to This Policy
We may update this policy from time to time. Material changes will be communicated via email to account holders or through the platform. Continued use of Foveate after changes constitutes acceptance of the updated policy.
